AUDIT SCOPE & METHODOLOGY


Scope of Review:


The audit examined autonomous and semi-autonomous AI systems deployed in building management across 47 facilities, including:


• HVAC optimization algorithms (45 facilities)


• Predictive maintenance AI systems (39 facilities)


• Energy management and consumption forecasting (47 facilities)


• Access control systems with AI-enabled anomaly detection (28 facilities)


• Occupancy analytics and space utilization AI (35 facilities)


Methodology:


The audit team conducted interviews with 84 facility managers, IT directors, and operations personnel. We reviewed model documentation, training datasets, validation reports, and incident logs. We assessed current governance practices against four regulatory frameworks: the EU AI Act (Articles 6-10 regarding high-risk AI applications), the NIST AI RMF (Govern, Map, Measure, Manage functions), ISO 42001:2023 (AI management system requirements), and IEC 62443-3-3 (industrial cybersecurity control requirements).

Issue: Our HVAC optimization AI systems (primarily Siemens-based thermal management algorithms) autonomously adjust temperature setpoints, damper positions, and chiller sequencing across 45 facilities without requiring human approval or maintaining explainable decision logs. The system can make operational changes affecting $8.2M in annual energy spend without documented decision rationale.


Example: At our Chicago facility (345K sq ft), the HVAC AI reduced cooling in the east wing by 6 degrees Fahrenheit for 47 consecutive hours. Facility management discovered this through occupant complaints, not through any alert system. When questioned about the decision, the AI vendor could not provide explainability. The decision was buried in 4.2M parameter weights with no interpretable output.


Regulatory Risk: EU AI Act Article 8 requires high-risk AI systems to maintain detailed technical documentation of how decisions are made. NIST AI RMF's 'Govern' function explicitly requires human-in-the-loop oversight for safety-critical systems. IEC 62443-3-3 demands logging and auditability of all control decisions. We are in violation of all three frameworks.

Finding #2: Access Control AI Without Interpretability (28 facilities)


Issue: 28 facilities use AI-powered access control anomaly detection systems that automatically flag or deny access requests based on behavioral patterns. These systems operate with zero transparency—facility managers do not know what factors trigger access denial. No employee has visibility into why they were denied entry.


Example: An employee at our Dallas facility was locked out of a secure server room for 6 days due to an access control AI's anomaly detection flag. The employee had taken a two-week vacation and then attempted to access the room in a different time window than usual. The AI system flagged this as suspicious. It took the audit team to investigate and override the system. No one—not the facility manager, not the employee, not IT—knew why access was denied. The AI made a security decision that affected operations without explainability.


Regulatory Risk: NIST AI RMF requires 'Measure' functions including transparency and interpretability metrics for decision-making systems. EU AI Act Article 13 explicitly requires users to understand how AI systems make decisions affecting them. We have neither. This is also a potential employment law violation—employees are being denied facility access without knowing why.


Compliance Gap: 0% of access control AI systems have interpretability mechanisms. 0% of employees who have been denied access understand the reason.


Finding #3: Energy Optimization AI With Documented Bias Toward Certain Building Zones (47 facilities)


Issue: Our building energy management AI optimizes consumption costs globally but appears to create disparate outcomes across facility zones. Analysis of 18 months of operational data reveals that the AI consistently prioritizes energy savings in zones with lower occupancy, resulting in warmer temperatures in those areas, while maintaining cooler temperatures in zones with higher occupancy and higher commercial value.


Example: In our New York facility, the energy AI maintains 71°F in the executive office zone (occupied 60% of business hours, ~$18K annual lease value per workspace) but reduces cooling in the call center zone (occupied 90% of business hours, ~$6K annual lease value per workspace) to 76°F. This creates a 5-degree differential. When we conducted bias testing, we found that the algorithm is optimizing for 'revenue per square foot' rather than 'occupant comfort,' leading to worse environmental conditions in lower-revenue areas. This disproportionately affects ~800 call center employees.


Regulatory Risk: NIST AI RMF explicitly requires bias testing and mitigation for AI systems that could create disparate outcomes. EU AI Act Article 6 classifies building management systems as high-risk when they affect occupant conditions. We have no documented bias testing. We have not disclosed this disparity to affected employees. ISO 42001:2023 Section 6.2 requires bias risk identification and mitigation. We have neither.


Compliance Gap: 0% of facilities have bias testing for energy AI. 0% have conducted disparate impact analysis across employee zones.


Finding #4: Occupancy Analytics With Zero Data Governance (35 facilities)


Issue: 35 facilities deploy occupancy analytics AI that tracks movement patterns, dwell times, and space utilization. This system processes movement data for ~50,000 employees daily. We have no data governance framework: no documented data retention policy, no employee notice of occupancy tracking, no consent mechanisms, no audit trails for data access.


Example: Our occupancy AI collects motion sensor data from every workspace, hallway, and meeting room. It builds behavior profiles showing which employees use which spaces when. This data has been retained for 3+ years without any purge policy. When we audited access logs, we found that 47 employees (including executives) have queried occupancy data without documented business justification. One employee ran 312 queries on specific individuals' movement patterns in a 90-day period. There is no accountability structure for this access.


Regulatory Risk: This data collection likely triggers GDPR Article 4 (personal data definition), CCPA if we have California employees, and emerging state-level biometric/occupancy privacy laws. NIST AI RMF's 'Govern' function explicitly requires data governance policies. We have zero. ISO 42001:2023 requires data management controls. We have none.


Compliance Gap: 0% data retention policy. 0% employee notification of occupancy tracking. 0% access controls for occupancy analytics data.


MAJOR FINDINGS (Risk Level: MEDIUM-HIGH)


Finding #5: Predictive Maintenance AI Trained on Outdated, Non-Representative Data (39 facilities)


Issue: Predictive maintenance models at 39 facilities were trained on 2018-2020 operational data. Current facility configurations, equipment, and operational patterns have changed significantly. The models are making recommendations for equipment failures based on outdated patterns, resulting in false positives and unnecessary maintenance calls. This is a NIST AI RMF 'Measure' violation—no model retraining or validation strategy exists.


Regulatory Gap: EU AI Act Article 10 requires high-risk systems to have continuous monitoring and validation processes. We have zero retraining schedule.


Finding #6: No Third-Party Audit or Validation of AI Model Performance (47 facilities)


Issue: Not a single building AI system in our portfolio has been independently validated by a third party. Vendors provide model performance metrics, but we have not commissioned independent testing. This violates ISO 42001:2023 Section 7.4 (validation and testing requirements) and creates liability if regulators question model performance claims.

Medium-Term (6-12 months):


5. Implement NIST AI RMF governance structure: appoint AI Governance Officer, establish Model Risk Committee, create quarterly model validation schedule.


6. Retrain predictive maintenance models on 2024-2026 facility data. Establish quarterly retraining schedule aligned with seasonal and operational changes.


7. Conduct independent audit of all 47 facility AI systems. Commission report by Q4 2026 to prepare for EU AI Act enforcement (August 2026 deadline).


AUDIT CONCLUSION


Our organization has deployed sophisticated building AI systems without corresponding governance frameworks. We are making autonomous decisions that affect energy spend, employee access, and occupant conditions without explainability, without bias testing, and without audit trails. This creates compliance risk under emerging regulatory frameworks (EU AI Act, NIST AI RMF, ISO 42001) and operational risk if systems fail or create unintended consequences.


The market has fundamentally shifted. Building AI governance is no longer optional. The regulatory environment is moving from voluntary guidance (NIST AI RMF, 2023) to mandatory enforcement (EU AI Act, August 2026). Organizations that build governance into their foundation will have competitive and compliance advantages. Those that try to retrofit governance afterward will face expensive, disruptive remediation.


Immediate action is required. We recommend allocating resources to implement a building-level governance framework within the next 6 months to prepare for regulatory enforcement and reduce operational liability.
