The Denominator Problem


In mathematics, dividing by zero is undefined. In building AI governance, it is the current operating standard.


Every building AI system has a numerator: the number of autonomous decisions it makes per day. Cooling adjustments. Access permissions. Energy load balancing. Fire detection thresholds. Ventilation rates. At scale, this number reaches into the tens of thousands per facility, per day.


And every building AI system has a denominator: the number of those decisions that are governed. Logged. Explainable. Auditable. Accountable to a named human.


For the vast majority of building AI systems operating today, that denominator is zero. And when you divide by zero, the result is not failure. It is something worse: it is undefined. You do not know whether the system is working. You do not know whether it is safe. You cannot prove either claim to a regulator, an insurer, or a parent.


This essay does not argue that building AI is dangerous. It argues that we have no way of knowing whether it is or is not, because we have never built the governance infrastructure to answer the question.


What If We Governed Building AI Like We Govern Pharmaceuticals?


When a pharmaceutical company builds a new distribution center, every system that touches a medication is governed. Temperature logs are continuous. Humidity is auditable. Chain of custody is documented from manufacturer to patient. The FDA does not ask whether the refrigeration unit was working. It asks for the governance record that proves it.


A company like Cencora moves $294 billion in medications through 140+ facilities annually. Their new AI-automated distribution centers feature autonomous mobile robots, cloud-based warehouse management, and AI-driven environmental controls. These systems are subject to Good Distribution Practice audits. Every autonomous decision that affects drug integrity must be traceable.


Now consider: the HVAC system in a data center running 250,000 GPUs makes decisions with equal or greater consequence to the cooling system in a pharmaceutical warehouse. A temperature excursion in a pharma facility destroys medication. A cooling failure in a hyperscale data center destroys billions of dollars in contracted computing capacity and potentially the hardware itself.


Yet the pharma system is governed to FDA standards. The data center system is governed to no standard at all. The numerator is comparable. The governance denominator is not.


What If We Governed Building AI Like We Govern Aviation?


Every system in an aircraft that affects flight safety has an audit trail. When autopilot adjusts altitude, that decision is logged, timestamped, and linked to a specific software version that was certified by a regulatory authority. If something goes wrong, investigators can reconstruct every autonomous decision the system made, in sequence, with full context.


Building AI systems make analogous decisions. A building management system controlling ventilation in a hospital adjusts airflow rates that directly affect patient health. A smart building controlling access in a school decides who enters and when. A data center cooling system prevents thermal events that could cascade into facility-wide failures.


But none of these decisions are logged to aviation standards. None are linked to certified software versions. None can be reconstructed by investigators after an incident. If a building AI system makes a decision that harms someone, the forensic trail does not exist.


We accept this because buildings feel mundane. They are not. A school building is not less consequential than an aircraft when the building AI controlling its air, its locks, and its fire detection serves 1,200 students daily.


What If We Governed Building AI Like We Govern Financial Systems?


When JPMorgan Chase processes a transaction, regulatory frameworks require that every algorithm involved in the decision is explainable, auditable, and compliant with fair lending laws. When an AI denies a loan, the institution must explain why in terms a regulator and a customer can understand.


Building AI makes decisions with comparable equity implications. When a smart building system prioritizes cooling in executive floors over shared workspaces, it is making a resource allocation decision. When a predictive maintenance algorithm defers repairs in certain facilities based on cost optimization, it is making a service equity decision. When a school building AI reduces ventilation to save energy during a heat wave, it is making a decision that disproportionately affects the students in that building.


Financial regulators demand explainability because unexplained decisions create systemic risk. Building AI creates the same risk, but there is no regulator asking the question. Yet. The EU AI Act, effective August 2026, will begin to change this.


The Governance Comparison


The gap becomes stark when you compare governance requirements across domains:


Building AI is the only domain on this list where the governance denominator is zero across all four dimensions. Not because the decisions are less consequential, but because the governance infrastructure was never built.


Why the Denominator Must Change Now


Three forces are converging to make the zero denominator unsustainable.


First, the numerator is accelerating. Every smart building deployment, every AI-optimized data center, every automated warehouse adds autonomous decisions. The gap between what building AI does and what anyone can verify it is doing grows daily.


Second, regulators are arriving. The EU AI Act enforcement begins August 2026. Building AI systems controlling safety-critical functions will likely be classified as high-risk. The question will not be whether your building AI is governed. It will be: prove it.


Third, the comparison is becoming visible. When a pharmaceutical company can demonstrate governance across its supply chain and a data center operator cannot demonstrate governance across its facility systems, the disparity invites scrutiny. When a school district can show educational AI governance but not facility AI governance, the inconsistency invites liability.


The Path to a Non-Zero Denominator


The Building Constitution provides the governance infrastructure that other domains take for granted. Three pillars move the denominator from zero:


Explainability means every autonomous building decision includes its reasoning. Not after the fact. Not in aggregate. Each decision, in real time, in terms a facility manager, a regulator, or a parent can understand.


Human-in-the-loop means irreversible decisions require human approval. A building AI that adjusts routine temperature settings operates autonomously. A building AI that overrides a fire suppression protocol does not.


Bias mitigation means actively checking whether building AI decisions systematically disadvantage any population. Whether that means cooling allocation across floors, maintenance prioritization across facilities, or ventilation rates across classrooms.


These are not aspirational principles. They are the same governance standards that pharma, aviation, and financial services have operated under for decades. The only difference is that building AI has never been asked to meet them.


That is about to change. The question is whether you define your governance denominator before a regulator, an insurer, or an incident defines it for you.
