LinkedIn Post #22: The EU AI Act Countdown
August 2, 2026. That's 168 days until the EU AI Act enforcement date. Your building tech is already covered — your vendor probably doesn't know it yet.
Here's what most CRE executives don't realize: The EU AI Act isn't just about chatbots and content moderation. It applies to the AI systems running your buildings right now.
That HVAC optimization system learning occupancy patterns? Limited risk under the EU AI Act. The predictive maintenance algorithm flagging failures before they happen? High risk if safety is involved. The access control system using behavioral analytics? Transparency obligations. Audit trails required.
The governance gap is stark. We analyzed 8 major building technology competitors. Eight out of eight have zero governance frameworks in place.
Meanwhile, the regulation is crystal clear: AI systems must have risk classification, documented decision transparency, human oversight protocols, and audit trails. Not suggested. Required.
Here's the real problem: If your company operates EU properties — or has EU tenants, EU investors, or EU data subjects — you need governance infrastructure now. August isn't when you start building compliance. It's when enforcement begins.
The vendors who ship features without governance are shipping liability.
The companies moving first aren't waiting for August 2. They're asking their building tech providers five critical questions:
Who governs what the AI decides?
Can you audit every decision after the fact?
What happens when the AI is wrong?
How do you test before deployment?
Who's accountable when harm occurs?
If your vendors can't answer those questions clearly, you already have a problem.
What governance questions are your building tech vendors struggling to answer?
DM me if you'd like to discuss governance readiness for your portfolio.
